Terms and conditions

These terms govern your access to and use of Kilipress (the “Service”), an AI-first content management system operated by Peak State (“Peak State”, “we”, “us”, “our”). By creating an account, connecting a repository, or otherwise using the Service, you agree to these terms. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation, and “you” means that organisation.
1. About the Service
Kilipress helps you design, draft, rewrite, and publish content for your own website. You provide a brief, brand context (such as voice, design, and audience notes), and existing content; the Service returns draft pages, draft articles, and layout proposals in your brand voice, and can publish them to your site. Edits land as commits to a Git repository you connect, which you can review, revert, and republish. The rendering engine is available separately as open-source software; the Service is the hosted commercial layer that runs the editor, meters the AI agent, hosts your site, and manages billing and access.
2. Your content and your responsibility as publisher
You decide what goes live. You are the publisher of everything published to your site through the Service, and you are solely responsible for it — its accuracy, legality, and its effect on your readers. This includes ensuring your content does not infringe intellectual property, defame anyone, mislead or deceive, or breach any law or regulatory obligation that applies to your business or your subject matter.
If your site provides information in a regulated field — financial, medical, legal, or similar — the licences, disclaimers, and professional obligations for that field are yours to hold and satisfy, not ours. The Service is a publishing tool. We do not review, verify, endorse, or take editorial responsibility for what you publish.
3. AI-generated content
The Service uses artificial intelligence to generate drafts and suggestions from the inputs you provide. AI-generated output can be incorrect, incomplete, biased, or inappropriate, and can misstate facts with apparent confidence. It is a starting point, not a finished or verified work. You must review, edit, and fact-check every AI-generated draft before publishing it. Because drafts are produced from your own inputs and general models, they do not take account of your specific circumstances and are not advice.
4. Not professional advice
The Service, our documentation, and any drafting or suggestions it produces are general in nature and do not constitute legal, financial, tax, medical, or other professional advice about your business. Peak State is a software provider, not your adviser. Before acting on anything the Service produces, obtain advice from a suitably qualified professional for your situation.
5. Accuracy of information
Content you connect or upload, and content generated from it, may be delayed, incomplete, duplicated, or miscategorised, and derived or reformatted output may be wrong as a result. We do not warrant that the Service, or any output, is accurate, error-free, or fit for a particular purpose. Verify against your source records before relying on anything the Service produces.
6. Eligibility
You must be at least 18 years old to use the Service. Where your workspace, team, or organisation shares access, you are responsible for the access you grant to others and for their use of the Service under your account.
7. Connected services and your data sources
The Service connects to third-party services on your instruction — for example a GitHub repository through our GitHub App, and payment processing through Stripe. You warrant that you have the authority and rights to connect those services and to upload or submit the content you provide. Third-party services are governed by their own terms; your relationship with those providers is your own. Disconnecting a service stops new collection from it but does not, by itself, delete content already imported or generated.
8. Acceptable use
You agree not to:
- use the Service to create or publish content that is unlawful, infringing, defamatory, harassing, or that you have no right to publish;
- attempt to disrupt, overload, reverse engineer, or gain unauthorised access to the Service or its infrastructure;
- use the Service to build a competing service, or to train a machine-learning model on the Service’s outputs at scale; or
- use the Service in breach of any applicable law or third-party rights.
9. Your content licence to us
You retain ownership of the content and materials you provide and of the content published to your site. You grant Peak State a limited, non-exclusive, worldwide, royalty-free licence to host, store, process, transmit, and display that content, and to send it to the subprocessors described in our Privacy Policy, solely to operate and provide the Service to you. This licence ends when the content is deleted or your account is closed, except for copies retained as required by law or held in routine backups for a limited period.
10. Intellectual property
The Service, its software, design, and brand (including “Kilipress” and “Peak State”) are owned by us or our licensors and are protected by intellectual property laws. These terms do not transfer any of our intellectual property to you beyond the right to use the Service as permitted here.
11. Fees and billing
Paid plans are billed through Stripe on the cycle shown at checkout. Unless stated otherwise, fees are payable in advance and are non-refundable except where required by law (including the Australian Consumer Law). You authorise us and our payment processor to charge your nominated payment method for the plan you select and any applicable taxes. We may change pricing on reasonable notice; changes take effect at your next billing cycle.
12. Third-party services and links
The Service relies on and may link to third-party services (such as GitHub, Stripe, and the providers listed in our Privacy Policy). We are not responsible for those services, their availability, or their content, and your use of them is governed by their own terms.
13. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded or limited. To the extent that our liability for a failure to comply with a consumer guarantee can be limited (and the guarantee does not relate to goods or services of a kind ordinarily acquired for personal, domestic, or household use), our liability is limited, at our option, to resupplying the services or paying the cost of having them resupplied.
14. Disclaimer of warranties
Subject to clause 13, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any output will meet your requirements.
15. Limitation of liability
Subject to clause 13, and to the maximum extent permitted by law:
- we are not liable for any indirect, incidental, special, or consequential loss, or for loss of profits, revenue, data, goodwill, or business, including any loss arising from decisions made or content published in reliance on the Service or its output; and
- our total aggregate liability arising out of or in connection with the Service or these terms is limited to the amount you actually paid us for the Service in the twelve months before the event giving rise to the liability (if any).
16. Indemnity
You agree to indemnify Peak State against loss, liability, and reasonable costs arising from your content, your use of the Service, or your breach of these terms — except to the extent the loss was caused by our own breach, negligence, or wilful misconduct.
17. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends. Clauses that by their nature should survive — including clauses 2, 3, 9, 10, 13, 14, 15, 16, and 20 — survive termination.
18. Changes to these terms
We may update these terms from time to time. If a change is material, we will take reasonable steps to notify you. Your continued use of the Service after a change takes effect means you accept the updated terms.
19. Governing law
These terms are governed by the laws in force in Australia, and you submit to the non-exclusive jurisdiction of the courts of Australia.
